TERMS AND CONDITIONS

1. Agreement to Terms

1.1 These Terms and Conditions (“Terms”) govern your participation in any photography workshop, event, or course (hereinafter collectively referred to as “Workshop” or “Workshops”) offered by Tuscany Photography Tours SRL Unipersonale (“Company”, “we”, “us”, or “our”). By registering for or attending any Workshop, you agree to abide by these Terms.

1.2 You represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are registering on behalf of a minor, you accept full responsibility for the minor’s participation and adherence to these Terms.

2. Registration and Payment

2.1 Registration for a Workshop is confirmed only upon receipt of a deposit payment. We do not require the full payment upfront but only two months before the tour begins. 2.2 Payment must be made in full no later than two months before the Workshop start date to secure your place. Failure to make full payment by this deadline may result in the forfeiture of your reservation. 2.3 We accept payment via international bank transfers, credit/debit cards and cash.

3. Definition of Workshop

3.1 A photography workshop is an educational event organized by the Company, designed to provide participants with instruction, guidance, and practical experience in the field of photography. Workshops may include classroom sessions, hands-on shooting exercises, field trips, and other activities aimed at improving participants’ photography skills and knowledge.

3.2 At Tuscany Photography Tours SRL Unipersonale, our primary objective is to facilitate a tangible advancement in your photographic expertise, with a specific emphasis on landscape, cityscape, street, and nature photography. Our workshops are meticulously designed to foster growth in your understanding and application of photography techniques, composition, and creative vision.

3.3 It’s imperative to note that all travel arrangements, including accommodations, meals, transportation, and other logistical aspects, are meticulously coordinated to optimize the learning experience. These arrangements are intricately intertwined with the primary goal of photography instruction, ensuring that the educational aspect remains the cornerstone of every workshop we conduct.

4. Assumption of Risk

4.1 Participants acknowledge and understand that participation in a Workshop involves certain risks and hazards, including but not limited to physical exertion, travel to and from workshop locations, exposure to outdoor elements, and use of photography equipment.

4.2 By voluntarily participating in a Workshop, participants assume all risks associated with such participation, including but not limited to personal injury, property damage, illness, and other hazards, whether known or unknown, arising from or related to their participation in the Workshop.

5. Health

5.1 Participants must be in good health and free from any medical conditions that may pose a risk to themselves or others during the Workshop. It is the responsibility of each participant to assess their own health and fitness level and to consult with a medical professional if necessary before participating in the Workshop.

6. Changes of Services

6.1 The Company reserves the right to make changes to the Workshop itinerary, schedule, instructors, locations, and other aspects of the Workshop at any time and for any reason. We will make reasonable efforts to notify participants of any significant changes as soon as possible.

6.2 In the event of a significant change to the Workshop, participants may have the option to receive a refund or transfer their registration to a different Workshop, at the Company’s discretion.

7. Cancellation and Refunds

7.1 Cancellations made within 60 days from the Workshop start date are eligible for a full refund, minus a 7% handling fee.

7.2 Cancellations made between 60 and 30 days before the Workshop start date are eligible for a 50% refund of the quoted price.

7.3 Cancellations made less than 30 days from the Workshop start date are not eligible for a refund.

7.4 Refunds will be processed using the same method of payment used for the original transaction. Refunds may take up to 15 business days to appear in your account.

8. Cancellation by Tuscany Photography Tours SRL Unipersonale

8.1 In the event that the Company must cancel a Workshop due to unforeseen circumstances, including but not limited to inclement weather, natural disasters, civil unrest, or other events beyond our control, we will make reasonable efforts to notify participants as soon as possible.

8.2 If a Workshop is canceled by the Company, registered participants will be offered the option to transfer their registration to a rescheduled Workshop (if available) or receive a full refund of the amount paid for the Workshop.

8.3 Additionally, if the scheduled workshop teacher is unable to conduct the workshop due to sickness or any other valid reason, the Company reserves the right to cancel the workshop. In such cases, registered participants will be promptly notified, and they will be provided with the option to transfer their registration to a rescheduled workshop or receive a full refund of the amount paid.

This addition ensures transparency and clarity in the event of workshop cancellation due to unforeseen circumstances, including the unavailability of the scheduled workshop teacher.

9. Indemnification

9.1 Participants agree to indemnify and hold harmless the Company, its employees, instructors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from or related to their participation in the Workshop, including but not limited to personal injury, theft, property damage, or infringement of third-party rights.

10. Insurance Recommendation

10.1 The Company strongly recommends that participants obtain travel insurance to cover any unforeseen circumstances, including trip cancellations, medical emergencies, and travel delays.

10.2 Additionally, participants are advised to obtain insurance coverage for their equipment, goods, and personal liability to protect against any potential damages or losses incurred during the Workshop.

11. Intellectual Property

11.1 All workshop materials, including but not limited to presentations, handouts, and online resources, are the intellectual property of the Company and may not be reproduced, distributed, or used for any purpose without our prior written consent.

11.2 Participants retain ownership of any photographs or other creative works produced during the Workshop. However, by participating in the Workshop, you grant the Company a non-exclusive, royalty-free license to use, reproduce, and distribute your works for promotional purposes.

12. Disclaimer of Warranties

12.1 The Company makes no representations or warranties of any kind, express or implied, regarding the content, quality, or outcomes of the Workshop. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

13.1 The Company shall be liable for any injury that guests might incur during the Workshop, provided that such injury is a direct result of the Company’s negligence or misconduct.

13.2 In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Workshop, even if we have been advised of the possibility of such damages.

13.3 Our total liability to you for any claim arising from or relating to the Workshop shall not exceed the total amount paid by you for the Workshop.

14. Governing Law and Jurisdiction

14.1 These Terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of Tribunale di Lucca (Italian jurisdiction), without regard to its conflict of law principles.

14.2 Any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the courts of Tribunale di Lucca (Italian jurisdiction), and you hereby consent to the jurisdiction and venue of such courts.

15. Changes to Terms

15.1 We reserve the right to update or modify these Terms at any time, with prior notice to all the enrolled participants in future workshops at the time of the change. Any changes will be effective immediately upon posting to our website.

16. Acknowledgment

16.1 By signing up for a Workshop, participants acknowledge that they have read, understood, and agreed to all of the aforementioned Terms and Conditions.
